Obituary for Lewis Franklin - Louis Franklin, 45 years old, a former resident of Sayville who left this community at the request of the law, died on Saturday afternoon as a result of a blow on the head sustained in a brawl which took place in the house where Franklin had been living of late in Middle Island. As a result of Franklin's death, Thomas Tovey, 37 years old, who lived with him, and Irving Huntley, 55, of Middle Island, have been held without bail for the action of the grand jury on charges of first degree manslaughter. Franklin's sister (mother), Eva Daniel, who has given varying ages to the authorities, but who is in her advanced years, also lived in the house with her brother (son) and Tovey.
According to testimony brought out at the inquest held by Coroner Grover A. Silliman, Huntley, who is employed in a nearby gas station, stopped in the place on Saturday morning. The three men drank some wine which was in the house and finishing that, bought another half gallon at a nearby resort. Early in the afternoon an argument arose over the payment of a grocery bill, and whether Mrs. Daniel's old age pension money should be used to pay the bill or to buy new glasses for her. The other men thought she needed the new glasses and Franklin belligerently announced he would pay the grocery bill. Some unpleasant words passed between him and Tovey and then they began to exchange blows. Huntley interceded to separate the two men, whereupon, it was testified, Franklin picked up a chair, saying he would "knock their brains out."
However, he put the chair down without carrying out his threat and then Huntley, according to Mrs. Daniels, struck Franklin with his fist, knocking him down. Franklin failed to revived after the blow and the others carried him to a couch, but could not restore him to consciousness. Unable to locate a physician, Huntley went to the Justice of the Peace, F.P. Marchant in Yaphank, stating that Franklin had dropped dead. Deputy Sheriff John Ed. Davis was sent to the scene and after arriving there, the called the Coroner.
Coroner Silliman ordered an autopsy on Franklin's body, which was performed, that night at the Mather Hospital in Port Jefferson by Dr. Reider Trygstad and Dr. F.L. McRae. The autopsy revealed that the only external mark of violence was a bruise on the left cheek, caused by some soft object; but that death had been due to cerebral concussion, with a hemorrhage covering the entire front of the brain. In view of the fact that there was no evidence of any diseased condition to have caused this, the opinion of the officials was that death was due to external violence.
Tovey and Huntley were charged with manslaughter at the direction of Assistant District Attorney Lindsay R. Henry, and Justice Marchant held them without bail for the action of the grand jury.
At the close of his inquest on Wednesday, Coroner Silliman's verdict was that Franklin's death was due to his being struck or pushed by Huntley.
Franklin at one time lived in Patchogue, but he and his wife were ordered out of that village by police five years ago for operating an alleged disorderly house on Lake Street. From there, Franklin and his wife moved to Sayville, but also left this community after their place had been raided by county officers. After that the pair separated and Franklin of late had been living at Middle Island. He leaves seven children, all of whom are under the care of the Child Welfare Board.
