The Reverend Edward Carlton Cumberbatch
This is the last Will and Testament of me Edward Carlton Cumberbatchof Penzance in the county of Cornwall Clerk.
I nominate constitute and appoint my beloved Wife Mary Gertrude Honoria together with Charles Cave of Cadogan Place, Middlesex,Esquire and the Revd Henry Parr Hamilton of Wath in YorkshireEXECUTRIX and Executors of this my Will and Guardian of such of myChildren as shall be under the age of twenty one years at the time ofmy decease and it is my wish that my said Children shall continue toreside with their Mother.
I direct that all my debts, funeral and testamentary expences (sic)shall be in the first place paid and discharged and I authorise mysaid Executrix and Executors to sell and dispose of any part of myfurniture, plate and other effects as they shall deem necessarytowards payment thereof and I give and bequeath unto my dear Wife allsuch furniture, plate, liuew? china and household effectsfor her ownuse and benefit as my said Executrix and Executors shall not thinknecessary to sell for the purposes aforesaid and I give and bequeathunto my said Executrix and Executors all the Rest, Residue andRemainder of my Estate and Effects whatsoever and wheresoever upontrust to collect, get in and receive the same and to invest theproceeds thereof in the Government funds of Great Britain and to paythe dividends, interest and annual product thereof unto her my saiddear Wife or to persist and suffer her to receive the same during theterm of her natural life or during so long as she shall continue aWidow and from and after her decease or second marriage I give andbequeath all my residue Estate unto and equally between and among allmy children in equal shares and proportions. The shares of such ofthem as shall be so as to be transferred and paid to them at the ageof twenty one years and the shares of such as shall be Daughters to betransferred and paid to them at the age of eighteen years; and Iauthorise and empower my said Executors to apply the income of thepresumptive share of any of my Children in or towards theirmaintenance, education and support until they shall respectivelyattain the ages aforesaid. I revoke and make void all former and otherWills by me at any time heretofore made and I publish and declare hispaper writing to be and contain my last Will and Testament. As witnessmy hand and seal this sixth day of October one thousand, eight hundredand thirty five Edward Carlton Cumberbatch {SEAL} Signed, sealed,published and declared by the said Edward Carlton Cumberbatch as andfor his last Will and Testament in the presence of Francis Vickers 2Eading Place, Lundon (sic).

APPEARED personally Charles Crocker of the Town of Penzance in theCounty of Cornwall, Cabinet Maker and Upholsterer and made oath thathe knew and was well acquainted with the Revd Edward CarltonCumberbatch, late of Penzance in the County of Cornwall Clerkdeceased, for some time before and to the time of his death also withhis manner and character of handwriting and subscription havingfrequently seen him write and subscribe his name and having now cast,fully viewed and inspected the paper writing hereunto annexedpurporting to be and contain the last Will and Testament of the saiddeceased the said Will beginning thus "This is the last Will andTestament" ending thus "this sixth day of October one thousand, eighthundred and thirty five" and thus subscribed "Edward CarltonCumberbatch" and having observed the initials or letters "ECC" writtenopposite an obliteration in the eleventh and twelfth lines of firstside of the said Will.
He further made oath he verify and in his conscience believes the saidsubscription "Edward Carlton Cumberbatch" as subscribed to the saidWill and also the said recited initials to be of the properhandwriting and subscription of the said Edward Carlton Cumberbatchdeceased. Charles Crocker on the 12th day of Feby 1836 the saidCharles Crocker was duly sworn to the truth of this affidavit byvirtue of the annexed Commission before me Thomas H. V____?
PROVED at London 22nd Feby 1836 before the Judge by the Oath of MaryGertrude Honoria Cumberbatch Widow the Relict, one of the Executors towhom admon was granted having been first sworn by Comon (sic) duly toadminister. Power reserved of making the like grant to Charles CaveEsquire and the Revd Henry Parr Hamilton Clerk the other Executorswhen they shall apply for the same.
